The Texas 3rd Court of Appeals has upheld to decision of a lower court judge dismissing two charges against Tom Delay. Ronnie Earle, Travis County embarrassment, er-r-r, District Attorney filed the appeal.

Basically the court disallowed Earle's attempt to charge Delay for breaking a law passed a year after the alleged behavior occured.

At this point, it is unlikely that Delay will ever see a trial. Democrat hitman Ronnie Earle is widely expected to appeal to the Criminal Court of Appeals (CCA) to extend the process, while Delay's lawyer's will fill motions for dismissal of the remaining charges.

With Delay not standing for reelection, this becomes for Ronnie Earle, a matter of avoiding embarrassment. He must hold onto the charges long enough for media attention to wane so he can sneak out the back door. Unfortunately for Earle, like all old Democrat political hacks, they just don't grasp that they are in a completely new media environment. There will simply be no place to hide on this.

Delay will be exonerated, although his enemies on the hysterial left will maintain his the myth of his corruption. More interesting is what Earle can expect. I predict Earle's career as a prosecutor, much less any higher political office, is over, primarily because he has become something the party cannot afford--an obvious embarrassment.
